The Federal Court of Australia dismissed the lawsuit filed by Greenpeace against Woodside Energy, closing a key case on climate strategy and emissions in the liquefied natural gas industry.

Context of the Climate Litigation

The legal dispute began in December 2023 when Greenpeace Australia Pacific questioned the veracity of Woodside Energy’s statements regarding its climate strategy and emissions reduction targets. The environmental organization alleged potential inconsistencies in corporate communications related to decarbonization.

However, the case was ultimately dismissed following an agreement between both parties, who decided to bear their own legal costs. Although there was no ruling on the merits of the accusations, the decision brings an end to one of Australia’s most closely watched climate litigations.

Impact on Woodside Energy and the Energy Sector

Woodside Energy, one of Australia’s leading LNG exporters, has been under constant pressure due to its reliance on hydrocarbons. The company has advocated for an energy diversification strategy, combining oil and gas projects with low-emission initiatives.

The case’s closure eliminates a significant reputational and legal risk for the company in a context where large energy companies face increasing scrutiny regarding ESG matters. Particular attention is given to Scope 3 emissions, which represent the largest portion of the carbon footprint in the sector.

Increase in Climate Litigation Globally

This case reflects a global trend where environmental organizations use courts to challenge the climate strategies of energy companies. Countries such as Australia, the United States, and several European nations have seen an increase in this type of lawsuit.

Likewise, these legal actions are influencing corporate transparency standards, investment decisions, and the viability of new energy projects.

Greenpeace’s Stance and Changes in Climate Strategy

Greenpeace considered the outcome a partial victory. The organization maintains that legal pressure led Woodside to modify certain messages related to its net-zero emissions target for 2050.

Furthermore, the group criticized the company’s reliance on carbon offset mechanisms and the exclusion of Scope 3 emissions from its climate commitments.
