Elon Musk’s ongoing struggle with major tech platforms has shifted its focus. X Corp and SpaceXAI, a division of SpaceX, requested on Monday to withdraw their claims against Apple in an antitrust lawsuit that challenged the iPhone company’s relationship with OpenAI.
However, Musk’s companies will maintain their claims against OpenAI, thus keeping the competitive conflict surrounding generative artificial intelligence open.
The document filed with the court does not explain the reasons for the withdrawal, nor does it specify whether Apple and Musk’s companies reached an agreement. OpenAI, which remains a defendant, stated it did not participate in the agreement and claimed ignorance of its terms. The company also requested X to make the agreement’s contents public, arguing it could affect both the case’s claims and its defense strategy.
Apple Exits the Front, OpenAI Remains in Dispute
X and SpaceXAI’s lawsuit alleged that Apple had infringed antitrust rules by integrating ChatGPT into Apple Intelligence, thereby favoring OpenAI over competitors. According to the accusation, both companies had used their position to block other developers’ access to the generative AI chatbot market.
Apple has rejected this interpretation, asserting that the integration of ChatGPT into its devices is not exclusive. OpenAI has also denied any wrongdoing and accused Musk of using a litigation strategy to pressure it. A judge allowed the case to proceed in November, providing a preliminary victory for Musk’s companies at that time.
The withdrawal against Apple significantly alters the landscape. The iPhone manufacturer ceases to be, for now, the direct adversary in this litigation, while OpenAI remains exposed to the claims from X and SpaceXAI. The legal issue thus shifts from a dispute over a specific partnership within the Apple ecosystem to a broader confrontation regarding competition among artificial intelligence platforms.
The Battle Is No Longer Just About AI Models
The technical-economic element emerging from this conflict is more significant than the withdrawal itself. Competition in artificial intelligence does not exclusively depend on who develops the model with the best capabilities. It also depends on who controls the model’s distribution and the user’s access point.
Apple possesses the operating system, devices, and a massive installed base; OpenAI provides ChatGPT, one of the most widely adopted generative AI services; while Musk is building an ecosystem connecting X, xAI, and the computational infrastructure associated with his companies.
The dispute reveals that the next competitive layer of AI may lie in the integration of these systems with the platforms from which users access them.
This dynamic transforms distribution agreements into strategic assets. Integration within a smartphone can provide an AI model with exposure that would be difficult to achieve solely through organic growth.
Musk Maintains Open Front Against OpenAI
The conflict also cannot be separated from the growing confrontation between Musk and OpenAI. In May, OpenAI secured a victory in another lawsuit filed by Musk, related to the alleged abandonment of the company’s original mission.
Now, X and SpaceXAI’s claims against OpenAI continue in a different scenario, after Apple has been removed from this part of the litigation.
The business dimension adds another layer. xAI acquired X for approximately US$33 billion, an operation also aimed at strengthening its capabilities to develop and train artificial intelligence systems.
The integration of a social platform with AI infrastructure and models is part of a trend where companies seek to simultaneously control technology, distribution, and data.
